Ameri-Care Privacy Policy: Protecting Your Personal Data
Last updated: September 1, 2026
This privacy notice describes how Ameri-Care Professional Service, Inc. collects, uses, stores, and shares information when you use our website, contact us, request services, submit a referral, apply for employment interest, complete a survey, or choose to receive text messages.
Questions about this notice or your information may be directed to [email protected] or 305-826-8800. Do not send clinical records or other sensitive health information by ordinary email or chat.
SUMMARY OF KEY POINTS
We collect information needed for the purpose you select. Contact, assistant callback, employment-interest, survey, referral-partner, and SMS marketing forms collect different information and are not interchangeable.
The Patient Referral Form may collect protected health information and clinical documents for referral review and care coordination through Ameri-Care's approved secure referral process. This website privacy notice does not replace our Notice of Privacy Practices. A public Cloudflare clinical-document upload portal is not currently active.
We do not sell personal information or share mobile numbers or SMS marketing consent for another party's marketing purposes.
1. INFORMATION WE COLLECT
Contact and assistant callback requests. We may collect name, phone number, email address, ZIP code, service interest, language preference, and the information you provide in a request. Please do not provide diagnoses, medical records, insurance member IDs, or other clinical information through chat or general contact forms. Chat messages and recent conversation context are sent to our AI service provider to generate responses. Assistant conversations are logged for safety and quality.
SMS marketing consent. Marketing text messages are optional and require a separate affirmative opt-in. We retain the phone number, consent language and version, source, date and time, and related opt-out status needed to document consent. Reply STOP to opt out. A callback request does not create SMS marketing consent.
Employment-interest requests. We may collect name, email address, mobile number, discipline, service area, availability, and optional notes to respond to an employment inquiry. Public employment-interest forms must not be used for resumes, identity documents, background reports, or clinical information.
Surveys. We collect the feedback and contact information you choose to provide. Do not attach medical records or enter sensitive health information unless Ameri-Care gives you an approved secure method for that purpose.
Referral partner coordination. The Referral Partner Express Lane collects organization and contact information, requested discipline, service ZIP, and requested start date for administrative coordination. It does not request patient identifiers, diagnoses, insurance information, or clinical documents.
Patient Referral Form. The Patient Referral Form may collect referring-provider information, patient name, date of birth, contact information, diagnosis, insurance information, and physician orders, face-to-face documentation, or other clinical documents needed for referral review and care coordination. Submit information only when you are authorized to make the referral or act for the patient. Use only the approved secure referral process for clinical documents. Do not use the form for emergencies; call 911 for an emergency.
2. HOW WE USE INFORMATION
We use information to respond to requests, coordinate referrals, evaluate service availability and coverage, administer surveys, maintain security and fraud controls, document consent and opt-outs, meet legal and operational obligations, and communicate with you about the purpose for which you contacted us.
Referral information is reviewed by authorized personnel. Submission does not guarantee admission, service availability, insurance coverage, or authorization. Clinical decisions, acceptance to service, and care planning require human review.
3. WHEN WE SHARE INFORMATION
We may share information with authorized workforce members and service providers that support our operations, such as hosting, form processing, security, communications, and records management, when permitted and subject to appropriate safeguards. We may also disclose information when required by law or to protect rights, safety, and security.
We do not sell personal information. Mobile information and SMS consent are not shared with third parties or affiliates for their own marketing or promotional purposes.
4. COOKIES AND TRACKING TECHNOLOGIES
Our website uses essential cookies and, subject to your choices, analytics and marketing technologies. These tools may collect device, browser, page-use, and cookie information. Do not submit clinical information through general website tools, chat, analytics prompts, or marketing forms.
Clinical referral activity must be handled through approved intake workflows. We do not authorize analytics or session-replay tools to collect the content of clinical referral fields or uploaded documents. Clinical documents must not be sent through general contact forms, chat, ordinary email, or marketing tools.
5. RETENTION
We retain information for as long as needed for the purpose collected, operational needs, consent records, legal requirements, dispute resolution, and records-retention obligations. Retention periods vary by form and record type. Virtual-assistant chat transcripts are retained for up to one year and deleted afterward, except where a legal hold or applicable law requires longer. Under 42 CFR 484.110(c), home health clinical records must be retained for at least five years after discharge unless state law requires a longer period. Ameri-Care applies its documented records-retention policy and any longer applicable requirement to clinical and referral records. Marketing and general contact data are reviewed and deleted or de-identified when no longer needed.
6. SECURITY
We use administrative, technical, and physical safeguards designed to protect information. No method of internet transmission or storage is completely secure. Use only approved channels for clinical documents and contact Ameri-Care promptly if you believe information was sent in error.
7. REFERRAL RECORD SAFEGUARDS AND COMPLIANCE
When Ameri-Care receives referral information or clinical documents through an approved secure process, access is limited to authorized workforce members and authorized service providers with an operational need to know. We use role-based access, unique user identification, authentication, encryption where appropriate, access and download audit logs, integrity checks, secure retention and deletion procedures, and incident-response and recovery processes designed to protect confidentiality, integrity, and availability.
These safeguards are designed to support the HIPAA Security Rule, including risk analysis, access control, audit controls, authentication, transmission security, incident response, contingency planning, and written business-associate assurances where required. They also support the home health clinical-record protections in 42 CFR 484.110, the HIPAA Security Rule in 45 CFR Part 164, Subpart C, and applicable Florida home health standards, including Florida Statute 400.497.
Before any public Cloudflare referral portal accepts clinical documents, Ameri-Care requires documented risk review, malware scanning and quarantine, protected-storage approval, role-based and audited access, secure retention and legal-hold procedures, recovery testing, staff training, and approval by the responsible privacy and compliance leadership. Until those controls are approved, clinical documents must be submitted only through Ameri-Care's approved secure referral process.
8. CHILDREN AND AUTHORIZED REPRESENTATIVES
Referral information for a minor or another person may be submitted only by an authorized parent, guardian, provider, facility representative, or other person with authority to do so. We may take reasonable steps to verify authority when required.
9. YOUR CHOICES AND RIGHTS
You may request access, correction, or deletion of eligible personal information, withdraw optional marketing consent, or ask questions about our practices by contacting us at [email protected] or 305-826-8800. Some information must be retained when required by law or healthcare record obligations.
10. POLICY UPDATES
We may update this notice when our forms, data practices, vendors, or legal obligations change. The Last updated date identifies the most recent revision.
